About

A tribunal's view of how a case is decided

Having sat as an arbitrator, Advocate Kansal looks at a case the way a tribunal does: what has to be proved, which documents prove it and how the order will be reasoned. Before the NCLT that discipline matters, because admission, claims and objections to a plan are decided largely on the record.

He leads the practice's work on insolvency petitions and their defence, resolution plans and the committee of creditors, avoidance transactions, oppression and mismanagement, and schemes of merger and arrangement under Sections 230 to 232 of the Companies Act, together with appeals before the NCLAT.

His years in government give him a working understanding of how departments, regulators and investigating agencies operate. This informs his advice on public-sector contracts and regulatory exposure, and his work in Enforcement Directorate and CBI matters, where he assists clients from the first summons onwards, including statements and attachment under the PMLA, FEMA proceedings, bail, discharge and trial before the Special Courts.
