Madhya Pradesh companies have their own NCLT bench in Indore. The Indore Bench of the National Company Law Tribunal hears insolvency and company law cases for companies registered anywhere in the state: Indore's soya processors and pharma companies, the auto and engineering units of Pithampur, Bhopal's real estate and education companies, Jabalpur and Gwalior manufacturers, and cement and power companies spread across the state.
The bench's office is at Office No. 1 and 7, RCM-11, Anandavan, Scheme No. 140, Indore. Before it began functioning, Madhya Pradesh cases were heard by another bench, and some older matters still carry that history. This page explains what the Indore Bench covers, how matters move, the kinds of cases it hears, and how we handle MP matters with associate counsel and online consultation.

Which companies go to Indore
Under Section 60(1) of the Insolvency and Bankruptcy Code, the bench is decided by the company's registered office. A company registered in Bhopal, Jabalpur or Gwalior is heard in Indore, just like an Indore company. A company with a plant in Pithampur but its registered office in Mumbai or Delhi goes to that city's bench.
Because Madhya Pradesh cases were earlier heard by another bench before Indore began functioning, older matters may have been transferred. If you are dealing with a case that started some years ago, check which bench now has it and whether earlier orders were passed elsewhere. For appeals, what matters is the bench that passed the order under challenge.
For personal guarantors of MP company loans, the Indore Bench is the forum. Group companies spread over several states may face cases in different benches.
Cases we commonly see from Madhya Pradesh
Soya and agro-processing
Indore and Ujjain soya plants and edible oil companies, where seasonal cash flows and bank limits cause defaults.

Companies in Satna, Katni and other districts, where state dues and mining leases affect the value of the business.
Real estate and townships
Developers in Indore and Bhopal with homebuyer and lender petitions.
Education companies
Colleges and schools run through private companies, where disputes concern control of land and buildings.
Family businesses
Trading and manufacturing groups in which family branches disagree, leading to oppression petitions.
How a matter moves at NCLT Indore
Check jurisdiction
We confirm the registered office from MCA records.
Prepare and e-file
Papers are filed on the NCLT e-filing portal with the fee paid online.
Defects and listing
The registry notifies defects, which must be cured within the time allowed. The matter is then numbered and listed.
Hearings
Matters are heard on the dates in the cause list. Virtual appearance may be allowed, depending on current practice and the matter.
Orders and appeals
Orders are uploaded on the NCLT website. Appeals go to the NCLAT at New Delhi.
Agro-processing and seasonal defaults
Soya processors and edible oil companies buy most of their raw material during a short harvest window and sell the processed product through the year. They depend on bank working capital limits, and a bad season, an export ban or a price crash can cause a default quickly. Banks then have to choose between restructuring, SARFAESI enforcement against plant and stock, and a Section 7 application.
For promoters of such companies, early engagement with lenders often works better than waiting for an insolvency filing. Where the company is an MSME, the pre-packaged process may also be available. For suppliers of seed and raw materials, Section 9 can work where the debt is undisputed and above Rs 1 crore, but disputes over quality are common, and a commercial suit may suit those cases better.

How we work on Madhya Pradesh matters
We are a litigation practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). For MP matters, this is what you can expect:
- Online first meeting: we review your papers and advise by video, so you need not travel.
- Associate counsel for appearances: we work with advocates who appear before the Indore Bench.
- Drafting from Delhi NCR: our team prepares the papers and strategy.
- Honest advice on forum: where the debt is disputed, a suit may be the better route.
- Written fee terms: agreed stage by stage, never linked to the outcome.
A seed supplier and an Indore processor
Here's a made-up example. A Maharashtra seed company supplied soya seed worth Rs 1.4 crore to an Indore processor, which paid part and then stopped. The processor's emails asked for more time but did not complain about the seed.
We confirmed the processor's registered office in Indore and sent a demand notice under Section 8, attaching the invoices, delivery challans and the processor's emails. No notice of dispute came within ten days. We filed a Section 9 application before NCLT Indore. The processor proposed a payment plan over four months with interest, which the seed company accepted, and the application was withdrawn before admission.
Restoring a Bhopal company
Here's a second made-up example. A Bhopal company that held a small commercial building had been struck off by the ROC at Gwalior for not filing returns. The directors had been collecting rent in their personal names, unaware of the strike-off. When they tried to sell the building, the buyer's lawyer refused to proceed.
We applied under Section 252 before NCLT Indore, showing the title deeds, rent agreements and property tax receipts in the company's name. The ROC asked for pending filings and costs. The bench restored the company on those conditions, and the directors regularised the rent accounts before completing the sale.

Mistakes we see in Madhya Pradesh filings
- Assuming a Pithampur plant means an Indore case when the registered office is in Mumbai
- Using Section 9 where seed or raw material quality was disputed before the demand
- Not checking whether an older case was transferred from another bench
- Missing the chance of an MSME pre-pack before a creditor files
- Sending notices to a godown instead of the registered office
Before your first hearing
For clients who are not based in Indore, we prepare a hearing note that sets out the dates, the amounts, the demand notice and any reply, with page references. Where the matter has history at another bench, the note includes the earlier orders. The bench will usually want to know whether the corporate debtor has been served and whether it has a real dispute or simply needs time to pay. A clear answer on both points saves adjournments.
Education companies and their land
Many schools and colleges in Madhya Pradesh are run by private companies or by trusts linked to companies. When disputes arise, they are often about who controls the land and buildings rather than the teaching. A family member may claim that the company holds land for the family, while others say it belongs to the company outright. Lenders may have a mortgage over the campus, and state rules may restrict how educational land can be used or sold.
Before filing an oppression petition or an insolvency application involving such a company, we check the title documents, any conditions in the land allotment, the role of any trust, and the affiliation or recognition conditions that apply to the institution. A resolution plan or a settlement that ignores those conditions may be impossible to implement. Where students' interests are affected, the bench is likely to look closely at continuity of the institution.
