The Chandigarh tricity is a business hub in its own right. Mohali has IT parks, pharma units and a growing start-up scene; Panchkula and the industrial areas of Chandigarh host light engineering, electronics and food businesses; and the city is the commercial centre for much of Punjab, Himachal Pradesh and parts of Haryana. It is also where NCLT Chandigarh sits, at Corporate Bhawan in Sector 27-B, hearing cases for companies registered across Haryana, Punjab, Himachal Pradesh, Jammu and Kashmir, Ladakh and Chandigarh.

We serve tricity clients through an associate office, with our Delhi NCR team preparing papers and strategy and attending contested hearings as agreed. This page explains what we do for businesses and individuals in Chandigarh, Mohali and Panchkula, the cases we see most, and how a matter runs.

A growing type of case

Personal guarantors in Punjab and Haryana

A large share of bank lending to small and medium businesses in Punjab and Haryana is backed by personal guarantees from promoters and their family members. When the company defaults and enters insolvency, lenders increasingly pursue the guarantors under Section 95 before NCLT Chandigarh, often after the company's own CIRP has ended in a plan or liquidation. Under Lalit Kumar Jain (2021), approval of the company's plan does not release the guarantors.

Since 26 May 2026, an insolvency application by or against a personal guarantor of a company loan no longer triggers an interim moratorium. Guarantors who once filed their own applications to freeze recovery cannot do so now. The defences that matter are on the merits: whether the guarantee was validly invoked, whether it is capped, whether the creditor changed the loan terms without consent, and whether recoveries from the company have been properly credited. A careful written response at the resolution professional's report stage can shape the outcome. See personal guarantor insolvency.

Acting from abroad

NRI shareholders in Punjab family companies

Many Punjab family companies have shareholders living in Canada, the UK, Australia or the United States who invested years ago and rely on relatives to run the business. When accounts stop coming, dividends dry up or shares are allotted to others, these shareholders can file an oppression and mismanagement petition before NCLT Chandigarh without travelling. Affidavits can be sworn before an Indian consulate or a notary with apostille, and hearings attended by video where the bench permits. The first step is usually to download the company's MCA filings to see what has changed. See oppression and mismanagement.

Our approach

How we work for tricity clients

We are a litigation practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), and an associate office in the tricity. This is what you can expect:

  • Local access: meetings and appearances through our associate office.
  • Guarantor defence on the merits: invocation, caps, discharge and credits.
  • NRI clients supported: attested affidavits and video meetings.
  • Honest advice: NCLT, DRT, suit or negotiation.
  • Written fee terms: agreed stage by stage, never linked to the outcome.
Avoid these

Mistakes tricity clients often make

  • Guarantors filing their own application expecting a moratorium after May 2026
  • Ignoring the RP's request for comments in a guarantor case
  • Filing a Mohali company's case anywhere other than Chandigarh
  • NRI shareholders waiting years before acting
  • Using Section 9 for a debt the buyer disputed before the notice

A Mohali guarantor and a capped guarantee

Here's a made-up example. A Mohali businessman had guaranteed his company's bank loan up to Rs 3 crore. After the company's CIRP ended in a plan that paid the bank part of its dues, the bank filed a Section 95 application claiming Rs 7 crore from him.

We submitted a detailed response to the resolution professional, attaching the guarantee deed showing the cap and the bank's own statement crediting the plan payment. The report recommended admission only for the capped amount less a share of the recovery. The guarantor then negotiated a settlement with the bank on that basis, which was recorded before NCLT Chandigarh.

A Canada-based shareholder

Here's a second made-up example. A shareholder living in Canada held 20% of a Ludhiana hosiery company run by his brothers. For four years he received no accounts. MCA filings showed that new shares had been allotted to his brothers' sons.

We filed an oppression petition before NCLT Chandigarh with an affidavit attested at the Indian consulate. He attended hearings by video. The bench restrained the new shareholders from voting pending the hearing and directed the company to give him all statutory documents. The family later agreed to buy his shares at an independently assessed value.

What we see

Mohali's IT and pharma companies

Mohali's IT parks and industrial areas host software and IT-enabled services firms and pharmaceutical units, alongside a growing number of start-ups. Their NCLT matters usually fall into three groups. Vendors and landlords pursue unpaid dues through demand notices and Section 9 petitions, where acceptance of the work or occupation of the premises is the key evidence. Founders and investors fall out over dilution, board seats and diversion of business, leading to oppression petitions. And pharma units in default to lenders raise questions about keeping licences alive during insolvency. For each, the starting point is the documents, and the registered office decides the bench, which for a Mohali company is NCLT Chandigarh.

A landlord and a Mohali IT company

Here's a made-up example. A Mohali landlord had leased an office floor to an IT company registered in Mohali. Rent of Rs 1.2 crore was unpaid for fourteen months while the company continued to occupy the premises. It had never complained about the premises.

Unpaid rent under a lease can be an operational debt. We sent a demand notice under Section 8 with the lease deed, rent invoices and the company's emails asking for time. No notice of dispute came within ten days. A Section 9 application was filed before NCLT Chandigarh. The company vacated and paid the arrears in three instalments under a settlement, and the application was withdrawn.
