The Jaipur Bench of the National Company Law Tribunal hears insolvency and company law cases of companies registered in Rajasthan. Its work reflects the state's economy: gems and jewellery houses in Jaipur, marble and granite companies in Kishangarh and Udaipur, textile mills in Bhilwara, handicraft exporters in Jodhpur, mining and cement companies, hotels across the tourist circuit, and a growing number of solar power companies in the west of the state.

The bench sits at G-6/7, Corporate Bhawan, Residency Area, Civil Lines, Jaipur. This page explains which companies it covers, the kinds of cases it hears, how a matter moves, and how we work on Rajasthan matters through our associate office in Jaipur. Jaipur is about five hours by road from our Dwarka office, which also helps when a hearing needs our own team.

Jurisdiction

Which companies go to Jaipur

The registered office decides the bench. Under Section 60(1) of the Insolvency and Bankruptcy Code, an insolvency application against a company goes to the NCLT for the place where its registered office is, and company petitions follow the same rule. A Bhilwara textile company or a Jodhpur handicraft exporter is heard in Jaipur. But many Rajasthan businesses have their registered office in Delhi or Mumbai, especially larger groups, and those cases go to New Delhi or Mumbai.

Personal guarantors of Rajasthan company loans are proceeded against before the Jaipur Bench. Where a group has companies in several states, cases may be split across benches; a transfer to one bench needs an application to the Principal Bench.

A Rajasthan point

Mining leases and state dues in a CIRP

Companies holding mining leases from the state government raise special questions in insolvency. The lease may be terminable on default, it may need fresh government approval on transfer, and the state may have royalty and other dues outstanding. In Ghanashyam Mishra (2021), the Supreme Court held that government dues not included in an approved resolution plan stand extinguished, but the lease itself remains subject to the conditions of the mining law.

Bidders for mining or cement companies in CIRP should take advice early on whether the lease will survive, what approvals are needed, and how state dues will be treated. The 2026 amendment also clarified that a charge created only by operation of law does not make government dues secured, which affects their ranking. See resolution plans and liquidation.

Our approach

How we work on Rajasthan matters

We are a litigation practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), and an associate office in Jaipur. For Rajasthan matters, this is what you can expect:

  • Local appearance: associate counsel in Jaipur attend hearings at Civil Lines.
  • Close enough to travel: Jaipur is a short trip from Delhi, so our own team can attend contested hearings.
  • Sector issues spotted early: mining leases, export receivables and state dues are flagged before filing.
  • Honest advice on forum: where the debt is disputed, a suit or arbitration may be better.
  • Written fee terms: agreed stage by stage, never linked to the outcome.

A transporter and a marble company

Here's a made-up example. A Gujarat transport company had moved marble blocks for a Kishangarh company for two years. Its bills of Rs 1.05 crore were unpaid. The marble company had never complained about the service, but kept asking for time.

We checked the master data and confirmed that the company was registered in Ajmer district. A demand notice under Section 8 went to the registered office, with the invoices, lorry receipts and ledger. No notice of dispute came within ten days. We filed under Section 9 before NCLT Jaipur. At the second hearing, the company offered payment in three instalments, which the transporter accepted, and the application was withdrawn.

Partners in a heritage hotel

Here's a second made-up example. Two families jointly owned a company running a heritage hotel near Udaipur, each holding 50%. One family managed the hotel and stopped sharing accounts or profits with the other. Board meetings were not held, and the managing family's relatives were put on the payroll.

The excluded family filed an oppression and mismanagement petition before NCLT Jaipur, treating the company as a quasi-partnership. The bench directed the company to share accounts and appointed an independent auditor to examine payments to relatives. With the audit report in hand, the families agreed that one would buy out the other at a value fixed by an independent valuer, and the petition was disposed of on those terms.

Avoid these

Mistakes we see in Rajasthan filings

  • Filing in Jaipur against a group company registered in Delhi or Mumbai
  • Overlooking lease conditions when bidding for a mining or cement company
  • Treating government dues as secured without checking the 2026 change
  • Relying on export receivables that are not documented properly
  • Waiting too long to challenge exclusion in a family hotel company
Practical preparation

Before your first hearing

Hearings at the Jaipur Bench move faster when the bench can see the key facts at once. We prepare a short note of dates, the amount in default, the date of the demand notice and any reply, with page references to the paper book. For family company disputes, we add a simple chart of the shareholding before and after the acts complained of. Where interim relief is needed, such as stopping a sale of hotel property or a new share issue, we explain clearly why harm will happen before the next date, because that is what the bench will ask.

A sector note

Gem and jewellery exporters in a CIRP

Jaipur's gem and jewellery exporters often have much of their value tied up in stock held on consignment abroad and in export receivables. When such a company enters insolvency, the resolution professional's first task is to find and secure those assets, which may be in several countries and in the hands of agents. Stock lent on approval to other dealers, a common practice in the trade, can be hard to trace without good records.

For creditors, this means the CoC should press early for a forensic review of stock movements and receivables in the period before insolvency, because these are the transactions most likely to be preferential or undervalued. For bidders, it means valuing the company on what can actually be recovered, not on book figures. For promoters, it means keeping clear records of every consignment, which is also the best defence if transactions are later questioned.
