Andhra Pradesh companies have their own NCLT bench at Amaravati, located in the APIIC Building in the IT Park at Mangalagiri, Guntur district. The Amaravati Bench hears insolvency and company cases for companies registered anywhere in the state: aquaculture and seafood exporters in the coastal districts, rice mills in the Godavari and Krishna deltas, steel and engineering companies in Visakhapatnam, pharma units in the Vizag and Nellore belts, power and infrastructure companies, ports and logistics businesses, and real estate developers in Vijayawada and Guntur.
Before this bench was set up, Andhra Pradesh cases were heard by the Hyderabad Bench, and some older matters still carry that history. Appeals go to the NCLAT's Chennai Bench. This page explains what the bench covers, the cases it commonly hears, how matters move, and how we work with associate counsel and online consultation.

Which companies go to Amaravati
Under Section 60(1) of the Insolvency and Bankruptcy Code, the bench is decided by the registered office. A company registered in Andhra Pradesh today goes to Amaravati. A company still registered in Hyderabad, even if its business is entirely in Andhra Pradesh, goes to NCLT Hyderabad. Since the state was divided in 2014, many companies have moved their registered office, but not all have. Check the master data before filing.
For matters that began before the Amaravati Bench started functioning, check whether the case was transferred and which bench passed earlier orders. For appeals, what matters is the bench that passed the order under challenge; appeals from both Hyderabad and Amaravati go to the NCLAT at Chennai.

How a matter moves at NCLT Amaravati

Prepare and e-file
Papers are filed on the NCLT e-filing portal with the fee paid online.
Defects and listing
The registry notifies defects, which must be cured within the time allowed. The matter is then numbered and listed.

Orders and appeals
Orders are uploaded on the NCLT website. Appeals go to the NCLAT at Chennai.
Aquaculture companies and seasonal risk
Shrimp farming and processing companies borrow heavily for feed, seed and processing capacity, and their income depends on export prices and the success of each crop. A disease outbreak or a fall in export prices can push a well-run company into default within a season. Lenders then face a choice between restructuring, SARFAESI action against ponds, plants and cold storage, and a Section 7 petition.
In a CIRP, the value of an aquaculture company can fall fast if ponds are left unstocked and the processing plant idle. Resolution professionals often need to keep operations going, which needs working capital and experienced staff. Feed and seed suppliers, who are usually operational creditors, should file claims promptly and watch whether they are asked to keep supplying during the CIRP. Where the company is an MSME, the pre-packaged process may also be an option for promoters before a creditor files.
Before your first hearing
For clients outside Andhra Pradesh, we prepare a hearing note with the dates, the amount in default, the demand notice and any reply, and page references to the paper book. For older matters with history at Hyderabad, the note sets out the earlier orders. The bench may ask whether the corporate debtor has been served and whether it has raised any dispute, so we keep proof of service and the correspondence ready.

How we work on Andhra Pradesh matters
We are a litigation practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). For Amaravati matters, this is what you can expect:
- Online first meeting: we review papers and advise by video.
- Associate counsel for appearances: we work with advocates who appear before the Amaravati Bench.
- Case history checked: for older matters, we confirm where the case stands and which bench passed earlier orders.
- Honest advice on forum: disputed claims may suit a suit or arbitration better.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes we see in Andhra Pradesh matters
- Filing against a company still registered in Hyderabad at the Amaravati Bench
- Assuming an old Hyderabad case is still pending there without checking
- Filing an appeal from Amaravati at the NCLAT in New Delhi
- Relying on a seasonal promise to pay instead of acting within limitation
- Using Section 9 where quality complaints were raised before the demand notice
A feed supplier and a shrimp processor
Here's a made-up example. A Telangana feed company supplied shrimp feed worth Rs 1.25 crore to a processing company registered in West Godavari. After a poor crop, the processor stopped paying, but never complained about the feed.
We confirmed the processor's registered office in Andhra Pradesh and sent a demand notice under Section 8 with the invoices, delivery challans and the processor's ledger confirmations. No notice of dispute came within ten days. A Section 9 application was filed before NCLT Amaravati. The processor's bank, worried about admission, supported a settlement under which the supplier was paid from the next season's export proceeds, and the application was withdrawn.
An old Hyderabad case
Here's a second made-up example. A Vijayawada company's lender had filed a Section 7 application before the Hyderabad Bench before Amaravati began functioning. The company's directors were unsure where the case now stood.
We checked the case status and found that it had been transferred to the Amaravati Bench, which had issued fresh notice. The company appeared, raised its defence on limitation and acknowledgments, and the matter was heard at Amaravati.
Rice mills and procurement dues
Rice mills in the Godavari and Krishna deltas often work with state agencies under custom milling arrangements, in which the mill processes paddy belonging to the government agency and returns rice. When a mill defaults to its bank, the paddy or rice in its godown may belong to the agency, not to the mill, and cannot be treated as the mill's asset. In a CIRP, the resolution professional must separate stock held for others from the mill's own stock, and claims by the agency need careful handling. Lenders and bidders should understand these arrangements before valuing a mill, and suppliers of bags, power and transport should file claims with clear records.
