Gujarat is one of India's most industrial states, and the Ahmedabad Bench of the National Company Law Tribunal carries a matching load. It hears insolvency and company cases for every company registered in Gujarat, from Ahmedabad's textile and pharma firms to Surat's diamond and textile businesses, Vadodara's engineering companies, Rajkot's machinery makers, Morbi's ceramic units and the new financial companies of GIFT City. It also covers the Union Territory of Dadra and Nagar Haveli and Daman and Diu.
The bench sits on the 1st and 2nd floors of Corporate Bhawan, behind Zydus Hospital, off S.G. Highway in Thaltej. This page explains which companies it covers, what kinds of cases are common, how a matter moves through filing and hearings, and how we work on Gujarat matters through our associate office in Ahmedabad.

Who we are here

Which companies go to Ahmedabad
The bench is fixed by the registered office. Section 60(1) of the Insolvency and Bankruptcy Code applies this to insolvency cases, and company petitions follow the same rule. So a company registered in Surat or Rajkot is heard in Ahmedabad, while a company with a factory in Gujarat but its registered office in Mumbai goes to NCLT Mumbai. Many Gujarat groups have holding companies in Mumbai, so check the master data carefully.
Companies in GIFT City, the International Financial Services Centre at Gandhinagar, are incorporated in Gujarat and so fall under the Ahmedabad Bench for company law and insolvency matters, although their regulatory supervision is by the International Financial Services Centres Authority. Where a dispute concerns an IFSC unit, we also check any special rules under the IFSCA framework.
For the Union Territory of Dadra and Nagar Haveli and Daman and Diu, companies in Silvassa, Daman and Diu come under the Ahmedabad Bench as well. These areas have many manufacturing units, and supply disputes involving them often become Section 9 cases.

How a matter moves at NCLT Ahmedabad
Check jurisdiction
We confirm the registered office from MCA records and look at the group structure to identify the right company.
Prepare and e-file
Papers are filed on the NCLT e-filing portal with the fee paid online. We check the bench's current notices on hard copies.
Defects and listing
The registry notifies defects, which must be cured within the time allowed (seven days for insolvency applications). The matter is then numbered and listed.
Hearings
The bench hears matters on dates given in the cause list. Urgent matters are mentioned at the start of the day. Virtual appearance may be allowed depending on current practice.
Orders and appeals
Orders are uploaded on the NCLT website. Appeals go to the NCLAT at New Delhi within the statutory time.
Environmental orders and insolvency
Chemical units in Gujarat's industrial estates sometimes face closure orders from the State Pollution Control Board or directions from the National Green Tribunal at the same time as insolvency. A closure order can make a company unable to pay, and the CIRP then has to deal with a business that cannot operate until it complies. Resolution applicants need to factor in the cost of compliance, and the resolution professional may need to work with the board on conditions for reopening.
Environmental liabilities are not simply wiped out by a resolution plan where they involve continuing obligations to comply with law. Bidders should take environmental advice early. Our network site environmentallawyer.in deals with pollution control and NGT matters.

How we work on Gujarat matters
We are a litigation practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), and an associate office in Ahmedabad. For Gujarat matters, this is what you can expect:
- Group structure checked: we identify the right company before filing, because many Gujarat groups have Mumbai holding companies.
- Local appearance: associate counsel in Ahmedabad attend hearings at Thaltej.
- Supplier claims made strong: we build the paper trail of orders, deliveries and ledgers before the demand notice.
- Honest advice: where the debt is disputed, we may suggest a commercial suit instead.
- Written fee terms: agreed stage by stage, never linked to the outcome.
A yarn supplier and a Surat weaver
Here's a made-up example. A spinning mill in Punjab supplied yarn worth Rs 1.2 crore to a weaving company registered in Surat. The weaver stopped paying, but never complained about quality. The mill's managers assumed they would have to sue in Surat's civil courts.
We checked the weaver's master data, confirmed its registered office in Surat, and sent a demand notice under Section 8 with the invoices and e-way bills. No notice of dispute came within ten days. We filed a Section 9 application before NCLT Ahmedabad through our associate office. The weaver offered a settlement in instalments, secured by post-dated cheques and a personal guarantee, which the mill accepted. The application was withdrawn before admission.
A family group divides its businesses
Here's a second made-up example. Two branches of a Vadodara family jointly owned a company running a chemicals plant and a packaging plant. After years of disagreement, they agreed to separate. A demerger of the packaging business into a new company, with shares allotted to all shareholders, followed by a share swap between the branches, gave each branch full ownership of one business.
The scheme was filed before NCLT Ahmedabad. Meetings of shareholders and creditors were held under the bench's directions, and notices were sent to the Regional Director, the ROC and the income tax department. The bench sanctioned the scheme, and the share swap completed the division.

Mistakes we see in Gujarat filings
- Filing against the Gujarat operating company when the contract was with a Mumbai holding company
- Using Section 9 for a debt where quality complaints were raised before the demand
- Ignoring the environmental status of a chemical unit when bidding in a CIRP
- Sending the demand notice to the factory instead of the registered office
- Missing the seven-day period to cure defects flagged by the registry
Before your first hearing
For clients outside Gujarat, the first hearing is often the moment of truth. The bench may ask whether the demand notice was delivered to the registered office, whether any dispute was raised before it, and whether the amount is above Rs 1 crore. We prepare a one-page note answering these questions, with page references to the paper book, so counsel can respond in seconds. If the other side files a reply raising a dispute, we check its date against the demand notice at once, because a dispute raised for the first time after the notice does not defeat a Section 9 application.
Surat's diamond trade and bank limits
Surat's diamond companies usually work on bank working capital limits backed by stock and receivables, and much of the trade runs on credit between known parties. When a large buyer abroad delays payment or the market falls, a company can breach its limits quickly. Banks may then classify the account as a non-performing asset and consider SARFAESI action against property, a DRT application, or a Section 7 petition before NCLT Ahmedabad.
For promoters, the main risk is personal: most diamond company loans are backed by personal guarantees. Since 26 May 2026, an application against a personal guarantor of a company loan does not trigger an interim moratorium, so a guarantor cannot freeze recovery simply by filing. Early, documented negotiations with the bank, supported by a realistic plan for the stock and receivables, often achieve more than litigation. See personal guarantor insolvency and defending a guarantor case.
