Insolvency and company law practice

About NCLT Lawyers

NCLT Lawyers is the insolvency and company law practice of Advocate B.K. Singh & Associates. We act for creditors, companies, promoters, shareholders and homebuyers before the National Company Law Tribunal, and in appeals before the NCLAT and the Supreme Court: demand notices and insolvency petitions, their defence, claims, resolution plans, liquidation, oppression and mismanagement cases, schemes of arrangement and restoration of struck-off companies.

Why we focus on the NCLT

Most people reach the NCLT at a difficult moment. A supplier who has waited a year for a large invoice to be paid, a lender whose borrower has stopped answering, a promoter whose company has just received a petition, a shareholder who has been removed from the board, a family of homebuyers whose project has stalled: each of them is suddenly in a process with its own rules, its own forms and its own short deadlines.

Read every paper, tell the client plainly what the law allows, and put every deadline in writing on the first day.

How we start every matter

Insolvency looks like a recovery tool. It often isn't. Once a petition is admitted, the company's management is suspended, a moratorium freezes most proceedings, and the creditor becomes one voice among many in a collective process. A missed claim deadline or a late appeal can cost a great deal. That is why we start by asking whether the NCLT is the right forum at all, and stay with a matter through admission, claims, the resolution plan and the appeal if it comes to that.

We don't promise results. We promise to read your file properly, file on time, and keep you informed after every hearing.

Who we help, and how

A creditor starting insolvency, a company facing it, and a shareholder in a company dispute each need a different plan. Here is how we usually help.

Creditors and lenders

Section 8 demand notices, Section 9 petitions for unpaid invoices, Section 7 petitions for lenders and homebuyers, and claims before the resolution professional.

Companies and promoters

Replies to demand notices and petitions, settlement and withdrawal under Section 12A, pre-packs for MSMEs, suspended directors and personal guarantors.

During insolvency

Committee of creditors matters, resolution plans and objections to them, avoidance transactions, moratorium questions and liquidation claims.

Shareholders and directors

Oppression and mismanagement petitions, illegal removal of directors, share allotments and transfers, rectification of the register and family company disputes.

Company corrections and schemes

Mergers, demergers and arrangements with creditors, reduction of capital, restoration of struck-off companies and compounding of offences.

Appeals

NCLAT appeals in IBC and company law matters, urgent stays of NCLT orders, and appeals to the Supreme Court on questions of law.

How we take a matter forward

Every file is different, but most of them move through the same four stages.

  1. Step 1

    Listening and reading

We hear your side, then read the loan or supply papers, the ledger, the demand notice and any petition or order. Limitation and every deadline are worked out on day one.

  2. Step 2

    Checking the company

We look at the company's MCA filings, charges, financial statements, other creditors and pending cases. These decide the bench, the strategy and how much a creditor may realistically recover.

  3. Step 3

    Choosing the route

An insolvency petition, a reply and settlement, a claim, an oppression petition, a DRT application, a suit or arbitration. You get our honest view of each option, what it costs and how long it is likely to take.

  4. Step 4

    Filing and appearing

We draft, file and appear before the NCLT bench and, on appeal, the NCLAT, and update you after every hearing so you are never left guessing.

What you can expect from us

We listen first

Plain language

We explain your rights and options without legal jargon, so you can make your own decisions.

Focused experience

Insolvency and company law cases before the NCLT and NCLAT are what this team works on day to day.

Honesty about outcomes

We tell you what's realistic, including when a settlement beats a long fight.

Organised, step-by-step support

From documents to hearings, you always know what happens next and what we need from you.

In our clients' words

Reviews shared by people we have worked with on Google. Every case depends on its own facts, and past results don't predict future outcomes.
